Frequently asked questions

How much can I sue for in Oklahoma if the letter is ignored?

Up to $10,000 exclusive of attorney fees and costs (12 O.S. § 1751). Covers money actions in contract or tort (libel/slander excluded), replevin, and interpleader. Collection agencies/assignees may not use the procedure, and filing waives the plaintiff's right to a jury trial on the merits. The court is the Small Claims Division of District Court. Filing fee: Restructured effective Nov. 1, 2025 (Laws 2025, c. 87): the old $58/$78/$178 small-claims tiers were removed from 28 O.S. § 152 — now a $150 flat fee for civil actions of $10,000 or less plus mandatory statutory add-ons, roughly $200–$215 total before service costs (certified mail ~$10; sheriff service $50). As of 2026; source: 12 O.S. § 1751; fees: 28 O.S. § 152.

Do I need a lawyer in Oklahoma small claims?

Attorneys are Allowed (12 O.S. § 1753 contemplates filing by 'plaintiff or plaintiff's attorney'; entities may instead appear through an officer, member, or employee per § 1751(G)). That matters before you send the letter: where lawyers are barred, the person reading your letter knows they will be arguing it themselves, which is part of why demand letters get paid. Source: 12 O.S. § 1751; fees: 28 O.S. § 152 (as of 2026).

Can I demand more than $10,000?

Yes — a demand letter has no cap; only courts do. If you are owed more than $10,000, the letter is the same and the follow-through would be Oklahoma's regular civil docket instead of the Small Claims Division of District Court.
