Frequently asked questions

How much can I sue for in Kansas if the letter is ignored?

A person may file no more than 20 small claims per calendar year. The court is the Small claims (Small Claims Procedure Act docket of the District Court). Filing fee: Docket fee under K.S.A. 61-4001: $35 (claims to $500), $55 ($500-$5,000), $101 (over $5,000), plus judicial-branch surcharges that counties add; expect roughly $50-$120 total.. As of 2026; source: K.S.A. 61-2703 (limit); 61-2707 (attorneys); 61-4001 (fees).

Do I need a lawyer in Kansas small claims?

Attorneys are Not allowed before judgment (K.S.A. 61-2707), except as provided in K.S.A. 61-2714 (e.g., when a party is an attorney, the court levels the field). Businesses may appear through a non-attorney officer or full-time employee.. That matters before you send the letter: where lawyers are barred, the person reading your letter knows they will be arguing it themselves, which is part of why demand letters get paid. Source: K.S.A. 61-2703 (limit); 61-2707 (attorneys); 61-4001 (fees) (as of 2026).

Can I demand more than $10,000?

Yes — a demand letter has no cap; only courts do. If you are owed more than $10,000, the letter is the same and the follow-through would be Kansas's regular civil docket instead of the Small claims (Small Claims Procedure Act docket of the District Court).
