What this means. The buyer takes the item in its current condition and cannot later claim the seller promised it was in better shape. It does not excuse the seller from active lies about the item, only from implied guarantees.

What this means. Federal law requires the seller of most vehicles to certify the odometer reading when ownership transfers, choosing one of three statements: the reading is the actual mileage, it exceeds the odometer’s mechanical limits, or it does not reflect the actual mileage (discrepancy). The buyer acknowledges the disclosure by signing. Many states require the disclosure on the certificate of title itself or on a separate official form — this clause does not replace those.

What this means. The seller confirms they actually own the item and that nobody else (a lender, a lienholder) has a claim on it. If that turns out to be false, the buyer has a clear basis to complain.

What this means. Records money the buyer already paid before signing so it counts toward the price. It avoids a later dispute about whether the deposit was received.

What this means. Use this when the item is given rather than sold — common between family members. Many states treat gifted vehicles differently: a separate gift affidavit may be required and the tax treatment differs. Confirm with your state DMV or tax office before filing.

What this means. When an item is owned (or bought) by two people — spouses, partners — both should be named and each seller and each buyer should sign. This clause names them and includes signature lines for them within the clause itself.
