Eviction Process in Florida

A Florida eviction is an action for possession in county court under the summary procedure of §51.011 (Fla. Stat. §83.59). The 3-day notice and the tenant’s 5-day deadline to deposit rent skip Saturdays, Sundays and legal holidays — for the 3-day notice, only holidays the court observes (§§83.56(3), 83.60(2)) — and each judicial circuit publishes its own holiday calendar.

Enter the date the notice was delivered: the calculator gives every step with its earliest legal date and the section of the statute behind it, as a PDF and as calendar events.

Texas default is 3 days unless a written lease sets another period.

How long does an eviction take in Florida?

If every step happens on the first day the statute allows and the tenant does not contest, about 15 days from the notice to removal by the sheriff: for unpaid rent with the notice delivered Monday, October 5, 2026, the earliest lockout is Tue, Oct 20, 2026. Holidays stretch it — a notice delivered Wed, Nov 25, 2026 takes 17 days. Real cases usually take longer, because the court sets the hearing and the sheriff executes the writ on their own calendars.

How Florida counts the days

  • For the 3-day notice: Saturday, Sunday and legal holidays are excluded, and for that section legal holidays are “court-observed holidays only” (§83.56(3)).
  • Every state court observes the paid holidays of §110.117 — New Year’s Day, Martin Luther King Jr. Day, Memorial Day, Independence Day, Labor Day, Veterans’ Day, Thanksgiving and the Friday after, and Christmas (moved to Friday or Monday when they fall on a weekend).
  • Circuits add their own closures. In 2026–27 the calendars we read (6th, 8th, 9th, 10th, 11th, 12th, 18th and 19th circuits) also close on some of: Presidents’ Day, Good Friday, Juneteenth, Rosh Hashanah, Yom Kippur, Christmas Eve and New Year’s Eve. The calculator shows a second date when one of those days changes the result.
  • Notices are delivered by mail, by hand, by e-mail under §83.505, or left at the residence if the tenant is absent; a lease cannot waive these notice requirements (§83.56(4)).

Example with holidays: a notice delivered Wed, Nov 25, 2026 expires on Wed, Dec 2, 2026 (skipping Thanksgiving Day, Friday after Thanksgiving), and the earliest filing day is Thu, Dec 3, 2026.

Frequently asked questions

How long does an eviction take in Florida?

If every step happens on the first day the statute allows and the tenant does not contest, about 15 days from the notice to removal by the sheriff: for unpaid rent with the notice delivered Monday, October 5, 2026, the earliest lockout is Tue, Oct 20, 2026. Holidays stretch it — a notice delivered Wed, Nov 25, 2026 takes 17 days. Real cases usually take longer, because the court sets the hearing and the sheriff executes the writ on their own calendars.

Do weekends count in a Florida 3-day notice?

No. The tenant has 3 days “excluding Saturday, Sunday, and legal holidays” after delivery, and for this notice legal holidays are court-observed holidays only (§83.56(3)). A notice delivered the day before Thanksgiving 2026 expires on Wednesday, December 2.

What does a Florida tenant have to do after being served?

A tenant who raises any defense other than payment must pay the rent alleged in the complaint into the court registry, or file a motion to determine the rent, within 5 days excluding Saturdays, Sundays and legal holidays after service; the answer is due within 5 days after service (§§83.60(2), 51.011(1)). The summons states the deadline.

What if the tenant does not deposit the rent?

It is an absolute waiver of the tenant’s defenses other than payment, and the landlord is entitled to an immediate default judgment, with the writ of possession to issue without further notice or hearing (§83.60(2)).

How long after the judgment does the sheriff remove the tenant?

The clerk issues the writ, and the sheriff puts the landlord in possession after 24 hours’ notice posted on the premises; Saturdays, Sundays and holidays do not stop the 24 hours (§83.62(1)).

Can a Florida landlord accept partial rent after the 3-day notice?

Yes, without waiving the eviction, if the landlord gives a receipt with the date, the amount and the agreed date and balance due before filing; or puts the partial rent in the court registry when filing; or posts a new 3-day notice for the new amount (§83.56(5)(a)).
